Insurance: when coverage is denied
People take out insurance to have peace of mind in difficult moments. That is why receiving a denial of coverage precisely when it is needed most is so frustrating. Life insurance, car insurance, home insurance, credit protection insurance and health plans are among the contracts that cause the most disputes between consumers and companies.
Not every denial is improper, but many are based on restrictive readings of clauses, on requirements that were not in the contract or on allegations that the insurer must prove. Our job is to review the policy, the general conditions and the reason given, and explain clearly whether there is a way to reverse the refusal.
The insurance contract and consumer relations
Insurance contracts are governed by the Civil Code and, in most cases, also by the Consumer Protection Code. This means that clauses limiting rights must be written prominently and clearly, and that doubts in interpreting the contract tend to be resolved in favor of the consumer.
The insured party also has duties: to provide truthful information when taking out the policy, to pay the premium on time, to report the claim as soon as possible and not to intentionally increase the risk. That is why we analyze the conduct of both parties before recommending any step.
Most common denials
In life and personal accident insurance, refusals based on a pre-existing condition are frequent. Brazil's Superior Court of Justice holds that such a refusal is unlawful when the insurer did not require medical exams before the contract or prove bad faith by the insured. Disputes over whether a disability is total or partial are also common.
In car insurance, denials usually involve claims of increased risk, a driver not listed in the profile, late installment payments or disagreements over the compensation amount in total loss cases. In home and business insurance, disputes revolve around the coverage contracted and the policy's exclusions.
In credit protection insurance, linked to loans and financing, families often discover after the policyholder's death that the debt should have been paid off by the insurer.
Health plans
Health plans are governed by specific legislation and supervised by the National Supplementary Health Agency, ANS. Denials of surgeries, tests, medicines, home care and ongoing treatments are among the most frequent claims. Since 2022, the law provides that the ANS list of procedures is a basic reference, allowing coverage of treatments outside the list when certain technical criteria are met.
In urgent and emergency situations, the maximum waiting period allowed by law is 24 hours. When health is at risk, it is possible to ask the courts for an injunction, that is, a quick order for the treatment to be authorized while the case continues. For this, a detailed medical report is the key document.
Deadlines: watch the clock
The deadlines to claim against an insurer can be short and vary according to the type of insurance and who makes the claim. In many cases, the insured's own deadline is only one year. So when you receive a denial, do not wait: keep the refusal letter and seek advice as soon as possible.
Before going to court, it is often worth filing a complaint with the insurer's ombudsman, the public consumer service platform or the regulators, such as SUSEP and the ANS. These steps can solve the problem faster and also serve as evidence that a solution was attempted.
Important documents
Gather the policy or individual certificate, the general conditions of the insurance, payment receipts, the claim notice, the denial letter and all messages exchanged with the insurer or broker. For life insurance and health plans, also gather medical reports, tests and records.
If you do not have the policy, the insurer is required to provide it. We help formally request any missing documents.
Another important point is the time the insurer takes to respond. Once the claim has been reported and the documents delivered, the company cannot leave the request pending indefinitely. Unjustified delays, repeated requests for the same documents and generic answers may also be challenged.
How our service works
In the initial conversation, we understand your case and ask for the documents available. We then analyze the denial, the risks and the alternatives, and present a written proposal with the fees. You follow every stage through the client portal and receive explanations in plain language.
We do not promise results, because each case depends on the contract and the evidence. We guarantee a technical and honest analysis, transparent communication and dedication so that the coverage you paid for is respected.
